Renter Requirements

  1. A renter must be current on all payments, including rent.
  2. A renter must comply with the rules of the board of health having jurisdiction in the area.
  3. A renter must maintain the premises occupied in a clean and safe condition and shall not unreasonably burden any common areas.
  4. A renter must dispose of all garbage and other waste in a clean and safe manner.
  5. A renter must maintain all plumbing fixtures in as sanitary a condition as the fixtures permit.
  6. A renter must use all electrical, plumbing, sanitary, heating, and other facilities and appliances in a reasonable manner.
  7. A renter must occupy the residential rental unit in the manner for which it was designed.
  8. A renter must comply with each rule, regulation, or requirement of the rental agreement.
  9. A renter may not increase the number of occupants above that specified in the rental agreement without permission of the owner.
  10. A renter may not intentionally or negligently destroy, deface, damage, impair, or remove any part of the rental unit or knowingly permit any person to do so.
  11. A renter may not interfere with the peaceful enjoyment of the residential rental unit of another renter.
  12. A renter may not unreasonably deny access to, refuse entry to, or withhold consent to enter the residential rental unit to the owner, agent, or manager for the purpose of making repairs to the unit.

What can be done about an unsatisfactory condition of a rental unit?

The first part of the process is to determine whether or not the issue with the rental unit is a deficient condition or a dangerous condition.

A deficient condition is a condition that violates a standard of habitability or a requirement of the rental agreement. The standard of habitability is that the premise must be fit for human habitation in accordance with local ordinances and the rules of the board of health having jurisdiction in that area. Additionally the rental unit must have electrical systems, heating, plumbing, and hot and cold water. The unit must be safe and sanitary and if an air conditioning system is installed it must be kept in an operable condition.
